1. Introduction
(a). Before registering for DHL Fast Forward, you must read these Rules and Conditions in their entirety. Upon registration for the online simulation, you are deemed to consent to and accept these Rules and Conditions without reservation. If you have a reservation or objection to any rule, condition or other aspect of these Rules and Conditions you should not proceed with registration, as registering for the online simulation constitutes your full and informed consent to these Rules and Conditions.

(b). The online simulation DHL Fast Forward and subsequent Final Level (hereinafter "the Game") is an initiative organized by Deutsche Post AG, Charles-de-Gaulle-Str. 20, 53113 Bonn, Germany, in the following document "Deutsche Post". References to Deutsche Post include Deutsche Post's affiliates worldwide as well as Deutsche Post's associates as specified in section 10, Miscellaneous, (a).


1.1 Purpose of the Game
(a). The Game is divided into three segments, the First Level, Main Level and Final Level. Persons who register are hereafter referred to as "Participant(s)". The First Level is open to all Participants who satisfy the conditions stipulated in section 3.1, First Level Conditions, (a). The First Level is intended to attract a wide range of Participants with varied and diverse experience and interests. The First Level will give Participants an overview of the operational and strategic decisions required by a domestic and international courier business.

(b). The Main Level is restricted to Participants who satisfy the conditions stipulated in section 4.1(b), Eligibility for the Main Level. In the Main Level, competitive pressure intensifies, Participants are organised into Teams and must compete for market dominance and at the same time develop their company into a globally operating logistics provider. The Final Level is likewise restricted to Participants who satisfy the conditions stipulated in 4.1(b). In the Final Level, the top performing Teams will compete in a non-internet based 2-day business challenge in Germany by exhibiting their business acumen to a jury. In the Final Level, the challenge is to improve the business of a global logistics provider by means of change management and strategy.


2. Registration
(a). Participants must register themselves for DHL Fast Forward to compete in the First Level. The information provided at registration must comply with the conditions stipulated in 3.1(a). The registration form specifies the obligatory fields which must be submitted; the Participant's first name and surname as stated in their passport, their valid email address, and their current country of residence. The country of residence stipulated will determine which region the Participant is assigned to. Participants must also accept the Rules and Conditions in the electronic form before they can proceed with the registration.

(b). Participants must choose a password in order to register for the Game. It has to be used to log into the Game. This password is the sole responsibility of the Participant, and Deutsche Post takes no responsibility for lost or forgotten passwords. Once registration is complete, the Participant will receive an email via their nominated email account providing their username and requesting confirmation of registration. Only after confirming registration, by clicking on the confirmation link contained in the email can Participants log into the website with their user name and nominated password. Participants invited to participate in the Main Level will be required to provide further information, as stipulated in 4.2.

(c). Inaccurate or misleading information will result in disqualification, see section 6, Disqualifications. All times and dates stipulated in this document are according to Coordinated Universal Time (UTC). Registration closes on July 08, 2008. Registration after this period is not possible.

3.1 First Level Conditions
(a). In order to compete in the First Level for the opportunity to be selected for the Main Level, all of the required registration criteria must be satisfied. Participants must fulfil these conditions at the time of registration:

  1. Participants must use the official registration form provided on the website. No other form of registration is acceptable,
  2. For the duration of the Game, as defined in Annex 1 (Timeline), Participants can not be employees, apprentices, trainees, or interns of Deutsche Post, nor have contractual relations or a contractual relationship with Deutsche Post, nor be a family member of a Deutsche Post employee, trainee apprentice or intern.
  3. Participants who are in the process of being recruited for a job, an apprenticeship, traineeship, or internship at Deutsche Post are permitted to play the Game. If subsequently employed as an employee, apprentice, trainee, intern or in another capacity at Deutsche Post, the Participant will be immediately disqualified from the simulation from the date of the Participant's acceptance of the relevant offer of employment,
  4. Participants must accept the online Rules and Conditions,
  5. Participants under the age of consent, as determined by their law of domicile, must have their parent's or guardian's consent to accept these Rules and Conditions and their parent's or guardian's consent to partake in the Game,
  6. Participation in the Game does not provide in any circumstances any right, interest or expectation of contractual relations with Deutsche Post, and participation in particular can not be considered to give rise to a right, interest or expectation of any form of employment agreement.

(b). Deutsche Post reserves the right to disqualify any Participant, without reason, regardless of whether all of the Registration Criteria are fulfilled.

(c). Deutsche Post reserves the exclusive right to amend the timeline, timeframes and duration of all aspects of the Game without warning or agreement from Participants. Should such amendment or modification occur, it will be duly published on the website www.dhl-discoverlogistics.com.

3.2 Playing the First Level
(a). Once a Participant has satisfied the registration criteria and duly registered they are able to compete in the First Level. The First Level can be played from May 01, 2008 to July 12, 2008, a period of ten weeks (refer to Annex 1, Timeline). Entry into the First Level is open; however participation is subject to the restrictions stipulated in 3.1(a). Eligibility for the Main and Final Level is restricted. Refer to section 4.1, Eligibility for the Main Level, for further details.

(b). The First Level comprises seven decision rounds each representing a six month period. During the online phase of the First Level, a Participant can play the First Level as many times as they wish. However, only the score of the most recently completed game is saved for the purpose of Main Level eligibility. Therefore, Participants are warned that should they decide to replay the First Level, the previous score is lost and only their most recent score is saved. The First Level must be completed for a score to be generated.

(c). Participants will require approximately a total of three to four hours to complete the entire First Level. This timeframe is a guideline only, and Participants are advised to investigate how long they will require to complete the First Level. However, Participants can save their progress in the First Level at any time and return later to complete the Level. Deutsche Post will endeavour to ensure that the save mechanism functions reliably. However, Deutsche Post takes no responsibility and bears no liability for any errors or malfunctioning of the save mechanism.

3.3 Bi-weekly Winners
(a). In each other week during the online period of the First Level, a bi-weekly winner will be determined and promoted in the Discover Logistics newsletter, and the winner will receive a prize. Winners will be determined by the achieved score according to the Game scorecard which considers factors such as financial and operational performance and sustainability.

4.1 Eligibility for the Main Level
(a). At the end of the First Level, Deutsche Post will determine the winners of the First Level.

(b). Eligibility to compete in the Main Level is restricted. Only Participants satisfying either of the following criteria are eligible for selection for the Main Level:

  1. the Participant is at the time of registration a full time tertiary student in a registered tertiary education provider, or
  2. the Participant is a person who has completed their tertiary education within the last five years.

(c). Additional Participant information must be provided in a second registration stage, as specified in 4.2. A Participant who does not fulfil either of the criteria stated above is not eligible for the Main Level Competition. Deutsche Post reserves the right to deny any Participant eligibility for the Main Level.

4.2 Main Level Registration
(a). At the end of the First Level, Participants who are invited to partake in the Main Level will receive an email requesting - if interested in competing in the Main Level - to logon to the website www.dhl-discoverlogistics.com with their login data and provide the following additional information:

  1. a contact telephone number
  2. the Participant's current residential address, including street, city and country and zip code and state or province where applicable
  3. the name of the university enrolled in for the degree specified
  4. the Participant's graduation date, actual or planned

This information may be required for travel and visa arrangements and in any event must be accurate and honest. Dishonest, inaccurate or misleading information supplied intentionally or otherwise will result in disqualification. Deutsche Post reserves the right to verify the validity of the information provided by Participants at the time of the Registration and at any time during the Game and to request copies of any documentation necessary to verify the validity of such information. Whether the documentation is deemed to verify such information is at the sole discretion of Deutsche Post.

Participants who fulfil the specified criteria and have successfully completed the Main Level registration may be selected for the Main Level competition or for the Main Level waiting list.

If a Participant is unable to compete in the Main Level for whatever reason, or fails to complete their profile according to the criteria specified in 4.2.(a) within the Main Level registration period, they will be disqualified from the Main Level. The next ranked Participant from their region will be contacted to replace the disqualified Participant.

4.3 Main Level Selection Process
(a). The Participants' First Level performance in each region is evaluated through a Game scorecard which considers factors such as financial and operational performance and sustainability. Out of each region, the highest scoring participants from the First Level will be invited to participate in the Main Level. These participants must fulfil the conditions stipulated in 4.1 to compete in the Main Level. There is no right of legal claim or challenge to the eligibility process or any amendment thereto.

4.4 Main Level Participation
(a). If a Player has been selected to participate in the Main Level, an email will be sent to the Participant informing them of their eligibility. Players who do not directly enter the Main Level may be selected for a position on the waiting list and have the chance to enter the Main Level if another Player drops out.

4.5 Main Level Teams
(a). Once the Main Level selection phase is complete (refer to Annex 1), Participants will be assigned into geographically representative Teams of five Participants each. Deutsche Post is solely responsible for the process of assigning Participants into Teams, and the decision can not be appealed or challenged. Participants have no input whatsoever into the formation of the Teams. Each team will have approximately a comparable total average score, e.g. as a cumulative total from the First Level. Deutsche Post will endeavour to create geographically diverse Teams. Ideally, this means one Participant from each region and no more than two Participants from one region. However, as the number of Participants and their geographical origin is uncertain, Deutsche Post reserves the right to create Teams as they see fit. Each Team will compete against nine other Teams in a defined market.

4.6 Test Round
(a). Once Teams have been assigned (refer to Annex 1), the Teams will play a test round. Teams will be grouped into lots of ten, and the test round will provide the opportunity to become familiar with the simulation, other Team members, and the organization of the Team. The organization, communication, and work of the Team is the Team's sole responsibility. Deutsche Post takes no responsibility for the organization, communication, work, or any other aspect of the Teams. The test round will last for six days, refer to Annex 1, during which the Team may decide that they are unable to work together. In this case, the entire Team will be disqualified and replaced by a new Team from the First Level Participants.

(b). To prevent Teams from drawing conclusions from the test round, especially about their competition, each Team will be reassigned in newly formed lots of ten to a new market before the Main Level begins.

4.7 Inactivity/Quitting
(a). If a Team member fails to login during the test round, or quits, or is inactive between the first and fourth period, the Team can request a replacement member from the same region. Replacing a Team member is not an automatic process, and to do so Teams must contact the simulation support. The decision whether to replace a Team member is at the sole discretion of Deutsche Post, and such a decision can not be challenged.

(b). A Team will be dismissed from the Game if the number of active members is below three. To remain active, a Participant must log into the Game each week. A Participant becomes inactive when they fail to log in for one calendar week. Deutsche Post takes no responsibility for computer or internet problems and it is the Teams' responsibility to ensure that they remain active. Deutsche Post reserves the right not to disqualify teams in which a team member has a legitimate reason to leave their team, as long as there are at least three team members continuing the Game. The reasons considered as legitimate by Deutsche Post are pregnancy, act of God, or hospitalization.

4.8 Playing the Main Level
(a). The Main Level covers a period of seven weeks, from August 06, 2008 to September 23, 2008 (refer to Annex 1). Each week corresponds to one year of business; seven weeks reflect seven years of simulated business. Each week (simulated year), Teams can take six days to make and submit their decisions (refer to Annex 1). On the seventh day of each week, the Teams' decisions will be processed. Once a Team has submitted their decisions, the decisions can not be altered or modified, nor can the week's decisions be resubmitted.

(b). Each Team is responsible for agreeing on the way they want to enter decisions. Each team member can enter any decision or alter decisions that have been entered by other team members up to the weekly deadline.

4.9 Main Level Decisions
(a). Decisions for each week must be submitted by the weekly deadline (refer to Annex 1). To ensure Participants are aware of an upcoming deadline, an automatic email will be sent to all Teams 24 hours before the week's deadline, reminding them to submit their decisions. This email will be sent to the Participants' email addresses provided at registration. Deutsche Post bears no responsibility and no liability for the sending and receipt of this email. Teams bear the sole responsibility for ensuring that their decisions are submitted before the deadline passes. Once decisions have been submitted by all Teams, the results of all Teams and markets are calculated and made available.

(b). Teams are forbidden to communicate with each other at any stage of the Game about any aspect of the Game, in particular but not limited to their strategy or any specific information concerning the Teams' decisions.

4.10 Late Decisions
(a). If a Team fails to submit their decisions before the weekly deadline, an additional period of 12 hours is available for Teams to submit their week's decisions. This late submission deadline will be communicated to Teams via email. Deutsche Post bears no responsibility and no liability for the sending and receipt of this email. Teams bear the sole responsibility for ensuring that their decisions are submitted before the deadline lapses. If a Team submits their decisions within this 12 hour timeframe, a certain amount of ?extraordinary expenditure' will be applied to the Team's company, as a penalty for late submission. The actual amount applied will be determined by the respective company's revenues and profit. This amount will be displayed in the company's Financial Report in the subsequent period.

(b). If a Team fails to submit their decisions within the additional 12 hour period, the Team will no longer be able to submit decisions for that week. In this case, the decisions from the previous week will automatically be used for the current week. Regardless of the circumstances, no decision can be submitted, received or considered once the extended deadline has passed.

5.1 Final Level Description
(a). The Final Level includes an invitation to the finalists to travel to the locations Berlin and Bonn, Germany. The Final Level of the Game will take place in a classroom rather than internet setting. The winning Team from each of the ten markets in the Main Level will be invited to participate in the Final Level.

(b). The Participants of those winning Teams that are invited to participate in the Final Level will be contacted via email and provided with more details regarding further procedures. Participants invited to the Final Level must confirm their participation within seven days. Upon confirmation of participation, Deutsche Post will organize their travel arrangements to the Final Level (refer to Annex 1).

(c). Deutsche Post undertakes to pay for the economy airfare or other reasonable travel expenses of each Participant invited to the Final Level and their accommodation expenses for the duration of the Final Level. The travel arrangements are to be consensually agreed upon between Deutsche Post and the Participants. Preference will be given to the most economic and direct travel arrangements. Deutsche Post reserves the right to select the form of transportation and the route taken by the Participant.

(d). Deutsche Post is not in any event to be held liable or responsible if a Final Level Team or single Participant is unable to travel to Bonn to participate in the Final Level.

5.2 Playing the Final Level
(a). The composition of the Teams in the Final Level will remain unchanged from their composition in the Main Level. The Teams will be required to demonstrate business acumen, creativity and ability to think strategically by working together and developing solutions to lead their company to sustainable success. Depending on the teams' demonstrated skills to develop those solutions, a multidisciplinary Jury will rate each team's performance. Based on the Jury's observations and judgement, the three best Teams will be selected as winners. Each member of these teams who has been personally present in the Final Level will be awarded with a prize.
In addition, based on their observations, the Jury will decide on the best overall individual player out of all teams. This individual will be awarded with a special prize.

5.3 Intellectual Property
(a). All Participants in the Final Level agree to cede their intellectual property in any of the content, solutions, concepts, or ideas they develop for the Final Level of the competition to Deutsche Post. Deutsche Post may use this content for publication, promotional measures, and other purposes. Also, Participants agree that Deutsche Post has the full right to use and publish any photographs taken of the Participants during the Final Level.
(b). All Participants in the Main and Final Level agree that they might be invited to take part in activities to support promotion and public relations for Discover Logistics and DHL Fast Forward. This might include media coverage of Teams or individual Participants through a public relations agency, communication with local Deutsche Post representatives in the Participant's country, and other activities. Participation in such activities is voluntary.


6. Disqualifications
(a). A Participant will be disqualified from the Game, with the effect that they will no longer be able to participate in the Game, if any of the following occurs:

  1. A Participant is, intentionally or otherwise, dishonest, inaccurate or misleading about any information supplied to Deutsche Post or Deutsche Post's representatives or agents,
  2. A Participant fails to complete the Game before the stipulated end date and time, for whatever reason,
  3. A Participant intentionally, or is judged to be intentionally attempting to crash the Game, or is submitting extreme and illogical decisions or exhibits any other behavior which is deemed by Deutsche Post to be detrimental, harmful or undesirable to the Game, Deutsche Post or any of Deutsche Post's interests. In such circumstances, Deutsche Post reserves the right to change decisions and/or alter the Game's market in any other way, to ensure the integrity and stability of the Game for other Participants and Teams,
  4. A Participant, during the course of the Game and in relation to the Game, acts inappropriately, offensively, objectionably or in any other way brings the Game, Deutsche Post or any of Deutsche Post's interests into disrepute,
  5. For any of the reasons provided in other sections of these Rules and Conditions,
  6. For any other reason, deemed by Deutsche Post to constitute a ground for disqualification.

(b). In addition to the grounds for disqualification above, a Team may be disqualified for any of the following reasons:

  1. The amount of "active members", for whatever reason, falls below three, unless Deutsche Post agrees otherwise. Deutsche Post designates "active member" to mean a Participant who logs into the Game at least once per calendar week (refer to Annex 1). Therefore, a Participant who does not log in within one week is an "inactive member".
  2. A Team intentionally, or is judged to be intentionally attempting to crash the Game, or is submitting extreme and illogical decisions or exhibits any other behavior which is deemed by Deutsche Post to be detrimental, harmful or undesirable to the Game, Deutsche Post or any of Deutsche Post's interests.
  3. For any other reason, deemed by Deutsche Post to constitute a ground for disqualification.

(c). If a Participant who is invited to the Final Level supplies inaccurate, dishonest or otherwise misleading information, they will be liable for the total costs incurred for their trip to the Final Level. Such costs include, but are not limited to, the airfare or travel costs as well as costs of accommodation which arise in connection with the Final Level competition in Germany.

(d). Any decision made by Deutsche Post relating to disqualification is at the sole and ultimate discretion of Deutsche Post. Deutsche Post's decision to disqualify a Participant or Team shall be final and conclusive and the Participant or Team has no right of recourse or any ability to legally challenge such a disqualification decision.


7. Communication & Support
(a). The following contact services provide support and help for various queries that Participants may have. Before using these services, please make sure that your query can not be answered by this document, or the Discover Logistics website, especially the FAQ section. Please read the descriptions of each support service carefully to ensure that the query is sent to the appropriate address. The support services are located on the Discover Logistics website in the Contact & Support section. All communication between Participants and Deutsche Post shall be exclusively through these support services.

Unregistered Persons:

  • General Questions
    This support service covers general queries relating to the Game, Participant eligibility, and other general queries relating to the scenario.
  • Press Contact
    Please direct any media related queries here.

Registered Persons:
Theses support services require the Participant to login using their registration data.
These services are only available for the durations of the Levels.

  • Simulation Support
    Queries relating to a specific issue in the First Level or relating to a particular round of the simulation in the Main Level.
  • Technical Support
    Any technical problems Participants may experience including difficulties with login, email or passwords.

(b). All support requests will be logged in a database along with the sender's email address for security reasons. While Deutsche Post undertakes to answer all queries within a reasonable timeframe, there is no guarantee that queries will be answered, whether due to unforeseen circumstances or other circumstances. Furthermore, Deutsche Post reserves the right not to answer any questions that in their judgment would give an unfair advantage to a Participant or Team.

(c). Participants undertake not to request or cause to be requested, information relating to the Game from any employees, apprentices, trainees, interns or other entities related to Deutsche Post. Participants and/or Teams who receive unofficial or content sensitive information relating to the Game that does or may provide any form of competitive advantage from any employees, apprentices, trainees, interns or other entities related to Deutsche Post must immediately inform Deutsche Post.


8. Prizes
(a). All prizes for the Game will be published on the website www.dhl-discoverlogistics.com. Deutsche Post reserves the right to amend and modify prizes as Deutsche Post deems necessary.

(b). In each other week of the online period of the First Level, a prize will be given away to one bi-weekly winner. The bi-weekly winner will be determined by the highest total score that has been reached in the respective week. The bi-weekly prizes will be shipped to the weekly winner's postal address at Deutsche Post's expenses.
At the end of the First Level, a special prize will be awarded to the 250 highest scoring Participants from Germany who have been invited to the Main Level and completed their personal information. These 250 Participants will receive a free 4-month subscription to the German edition of The Financial Times. Subscription will be automatically terminated after the 4-months period without further notice.

(c). In the Final Level, each member of the three best teams participating in the Final Level will receive a prize.
In addition to the team prizes, the best individual Participant in the Final Level will receive a special prize. This individual will be selected by their individual performance exhibited in the First Level as well as by the assessment of the individual's performance in Level 3.
All prizes of the Final Level will be handed over to the winners at the last day of the Final Level. The prizes consist of vouchers, which have to be redeemed within one year's time. The details of how to redeem the vouchers will be provided together with the vouchers.

9.1 Relations with the Media
(a). The Participants and/or Teams are not authorized to directly or indirectly contact the media, or any media enterprise and/or to meet journalists or their associates, unless they have obtained the express authorization of Deutsche Post. Any Team or Participant that contacts the media or journalists without the express authorization of Deutsche Post shall be disqualified.

9.2 Legal Challenge Excluded
(a). Only Teams and Participants that have participated in the competition can benefit from the outcomes.

(b). Any legal claim(s) to participate or proceed or win in the competition are definitively excluded. Deutsche Post has the exclusive right to select the winners, depending on the competition and their judgment of the Participants. No legal claim or challenge can be brought against the Game, the decisions of Deutsche Post relating to the Game, or the outcome of the Game.

9.3 Confidentiality
(a). By participating in the Game, the Participants will have access to information and knowledge, in particular, commercial, financial, operational, industrial and/or marketing information, concerning the activities, operations and strategies of Deutsche Post. The Participants shall take all necessary measures to keep such information strictly confidential, except for information already in the public domain. The Participants acknowledge that the disclosure of such information would be likely to cause Deutsche Post significant damage, and accordingly the participants' liability is engaged. The duty and obligation of confidence shall endure until such time as the object of this clause ceases to exist.

9.4 Personal Information
(a). Deutsche Post will take appropriate measures during the gathering of Participants' personal information, including encoding, to ensure and prevent as far as possible, any unauthorised or illegal access to or exploitation of such personal information.

(b). Deutsche Post advises participants who are invited and/or participate in the Main Level, that their email address, name and country of residence will be communicated to the other members of their Main Level team to facilitate communication and teamwork within their Team.

(c). By participating in the Game, the Participants agree that their personal information may be shared with any of Deutsche Post's affiliates worldwide for promotional and communication and recruiting activities as well as with third parties that are directly involved in the development and promotion of the Game.

(d). By participating in the Game, the Participants agree that their personal information may be communicated to third parties involved in organizational processes of the Game as required. Theses processes include, but are not restricted to visa, travel and accommodation arrangements, shipment of prizes, organization of the Final Level, etc.

9.5 Reproduction Rights
(a). Any resemblance or similarity between the Participants' and Teams' operational decisions and strategies made, developed or followed by the Participants and the operational decisions and strategies of Deutsche Post are purely fortuitous. Furthermore, no intellectual property can vest in participants resulting from their Teams' operational and strategic decisions.

(b). By registering for the Game, the Participant accepts to gratuitously guarantee to Deutsche Post the right to use and publish their name, country of residence, age, profile and their quotes through any type of medium for the purpose of, but not limited to advertisements and other promotional purposes, without additional remuneration, throughout the world and on the internet and any other medium without limitation. Deutsche Post may also publish in any medium any results and other aspects relating to the Game at any time.

9.6 Complaints
(a). Any issues, disputes or challenges concerning or arising from the Game or these Rules and Conditions shall be exclusively settled by Deutsche Post. The decision of Deutsche Post shall be binding and final. There is no right of recourse, legal challenge or otherwise, to such a decision.

(b). The Game and these Rules and Conditions are governed exclusively by German law. Should a dispute arise form the Game and/or these Rules and Conditions, only a competent German court has jurisdiction to hear the claim and only German law will be applied to settle the dispute.


10. Miscellaneous
(a). Deutsche Post's associates are defined to include, but are not limited to, TATA Interactive Systems GmbH, Pleon Media, Financial Times Deutschland and Interone Worldwide GmbH.

(b). All the times and calendar dates stipulated in the Rules and Conditions are for the UTC time zone.

(c). The original and official version of the Rules and Conditions and their Annexes are deposited at www.dhl-discoverlogistics.com and are the sole Rules and Conditions that are valid.

(d). Deutsche Post reserves the right to shorten, modify or cancel the Game, especially in, but not limited to the event of bugs, viruses, or other computer or internet problems, unauthorized human intervention or other circumstances outside of Deutsche Post's control that would bring the administration, security or proper functioning of the Game or the information and data contained therein, into question.

(e). In the event that the game is shortened, modified or cancelled, Participants and Teams have no right to claim for losses arising from such a situation, nor any legal or other vested interest.

(f). The Game including, but not limited to its concept, content, appearance, and any graphical component and its format, operation and organisation are and shall remain the sole property of Deutsche Post.

(g). There is ample opportunity to consult a lawyer or other legal profession before registering for the Game. Accepting the Rules and Conditions constitutes a Participant's full and informed consent and furthermore that the opportunity to seek legal advice was given.

11. Data Protection Policy
